CONSULTATION PREPARATION

Criminal decision and appeal: what to bring first

Preserve the full decision and the evidence of notification before assessing any remedy.

Decision and notification

Bring the full reasoned decision, attachments and delivery information. Distinguish the date of the decision from when it was notified to you or your representative. Tell the lawyer immediately about any date mentioned by the court.

The earlier file

Organise the charge, earlier decisions, submissions and hearing records you hold. Identify material that is missing and any previous lawyer involved, so the review can establish which records must be obtained.

Questions for the consultation

Explain which findings you dispute and what outcome you seek. Separate concerns about facts, evidence, procedure and the sentence. The lawyer assesses the available grounds and remedy from the complete file.

Confirm responsibility for deadlines

Do not calculate a filing deadline from another person’s case. Confirm the applicable date, agreed scope and who is preparing and filing any appeal. An enquiry does not suspend a deadline.

General information for preparing a file. The applicable rules and specific steps are checked during the consultation against your circumstances and current legislation.
